Sample Description of a “Private Administrative Process” for a Debt Discharge:

  1. Send a well-prepared and detailed Novation Contract with a check or money order for $100 stating that if they keep or deposit the check and do not return it within 72 hours (according to GAAP and UCC 3-603), the debt is discharged.
  2. Demand validation of the debt by mailing a “Private International Remedy Demand” and “Debt Collector Disclosure Statement”.
  3. Include an RRSA Request Regarding a Statement of Account according to UCC 9-210.
  4. The alleged debt collector cannot legally prove a valid balance on the account still exists under penalty of perjury (which they won’t do).
  5. Solicit a third-party custodian of records to witness your correspondence and certify non-responses and tacit agreement using affidavits of non-response and service. Keep all mail receipts and delivery proof.
  6. Send Notices of Fault, Notice of Default, and Statement of Claim or Certificate of Claim. File public notice with a County Recorder or as a UCC-1 (non-UCC filing designation).
  7. File the Abstract and Statement of Claim in a miscellaneous case file in Federal District Court.
  8. Get a certified copy of the court filing and send it to credit bureaus with a Statement of Claim and Notice to Remove Derogatory Items.
  9. Keep your records ready in case a third-party collector or law firm contacts you, or if they initiate a lawsuit.
  10. Maintain copies of all correspondence so you can invoice them: $1,000 per call, letter, or threat; $10,000 per lawsuit. If sued, file an Answer and Counterclaim and include your record as evidence.
